These Terms of Service govern your access to and use of our Personal Color Analysis service, including the website, analysis tools, generated reports, account features, and payment features.
By using the service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.
The Service
The service allows users to upload photos for Personal Color Analysis. We may analyze uploaded photos using AI providers and generate color analysis results, including report images and related text.
The service is provided for informational, educational, lifestyle, and personal styling purposes. It is not medical, professional, employment, legal, or identity verification advice.
Account Access and Security
Some features may require you to sign in with a third-party login provider such as Google. We do not store your login provider password. You are responsible for keeping your account access secure and for all activity under your account.
We may suspend, restrict, or terminate access to the service if we believe you have violated these Terms, created security or abuse risks, or used the service unlawfully.
Uploaded Photos
You are responsible for the photos you upload. By uploading a photo, you confirm that:
- You own the photo or have the necessary rights and permissions to use it with the service.
- If the photo shows another person, you have that person's permission to upload the photo and request analysis.
- You will not upload photos that are unlawful, abusive, exploitative, invasive of privacy, or infringe another person's rights.
- You will not upload photos of children under 13 unless you are the parent or legal guardian or otherwise have lawful authority to do so.
You keep ownership of your uploaded photos. You grant us a limited, non-exclusive, worldwide license to host, transmit, process, analyze, and temporarily store uploaded photos only as needed to provide, secure, maintain, comply with law, and enforce these Terms.
We do not claim ownership of your uploaded photos. We do not use uploaded photos for unrelated advertising, resale, or training our own models without your explicit permission.
AI Processing and Temporary Storage
To provide Personal Color Analysis, uploaded photos may be sent directly to third-party AI providers or model inference providers for analysis. For larger photos or technical processing needs, photos may be temporarily stored in our storage infrastructure before or during analysis.
Temporary uploaded photos are used only to operate the service and are scheduled for deletion. We do not intentionally keep uploaded photos on our servers long term or use them for purposes unrelated to providing the service.
Because the service depends on third-party AI and infrastructure providers, your uploaded photos and generated results may be processed by those providers according to their applicable terms, privacy policies, and security practices.
Generated Reports and Records
Generated reports may include image reports, color palettes, descriptions, styling suggestions, and other analysis output.
Free users' generated report images are stored only in the user's browser or client-side session. We do not intentionally store free users' generated report images in backend storage.
Paid users may have generation records so they can view or retrieve recent reports. Paid users' generated report images and related generation records are retained for a limited time and automatically deleted no later than 12 days after generation, unless deletion is required sooner by law, security needs, or a valid user request that we are able to honor.
You are responsible for downloading or saving any report that you want to keep beyond the retention period. We are not responsible for loss of reports after deletion, expiration, browser clearing, account issues, or technical failures.
Accuracy of Results
AI-generated Personal Color Analysis may be imperfect, subjective, or affected by photo quality, lighting, camera settings, makeup, filters, background color, image compression, and other factors.
We do not guarantee that any analysis, recommendation, color palette, or report will be accurate, complete, suitable for every purpose, or consistent across repeated uses.
Acceptable Use
You agree not to use the service to:
- Violate any applicable law or regulation.
- Upload or process content without the necessary rights, consent, or authority.
- Upload content that is defamatory, obscene, abusive, harassing, hateful, exploitative, violent, or otherwise unlawful.
- Upload, generate, or share child sexual abuse material, non-consensual intimate imagery, or content that exploits or harms minors.
- Harass, stalk, impersonate, deceive, or harm another person.
- Infringe intellectual property, privacy, publicity, or other rights.
- Attempt to bypass security, rate limits, payment controls, or access restrictions.
- Scrape, harvest, or extract data from the service except as expressly permitted.
- Reverse engineer, decompile, or attempt to discover non-public source code, models, prompts, systems, or algorithms, except where applicable law prohibits this restriction.
- Interfere with or overload the service or its third-party infrastructure.
We may remove content, block processing, suspend accounts, or report activity to authorities when we believe it is necessary to protect users, the service, or the public.
Intellectual Property
The website, software, interface, branding, documentation, and other materials we provide are owned by us or our licensors and are protected by intellectual property laws.
Except for the limited rights needed to use the service, these Terms do not transfer any ownership rights to you. You may not copy, modify, distribute, sell, or create derivative works from the service except as allowed by these Terms or applicable law.
Your Content and Feedback
You retain your rights in photos and other content you upload. The limited license you grant us is only for operating, securing, maintaining, and enforcing the service as described in these Terms and our Privacy Policy.
If you provide feedback, suggestions, or ideas about the service, you grant us permission to use them without restriction or compensation. This does not give us ownership of your uploaded photos or generated reports.
Billing
The service may include free and paid features. Prices, included usage, credits, subscriptions, and feature limits may vary by plan, region, promotion, or account status.
Payments are processed by third-party payment providers such as Stripe. By purchasing a paid feature, you agree to provide accurate billing information and authorize the applicable charges.
Unless otherwise stated at checkout or required by law, fees already paid are non-refundable. If subscriptions are offered, renewal and cancellation terms will be presented at checkout or in account settings.
We may change pricing, plan limits, or paid features from time to time. Changes will apply as described at checkout, in your account, or in a notice we provide.
Third-Party Services
The service may depend on third-party providers for hosting, storage, analytics, authentication, payments, AI model inference, and other infrastructure. We are not responsible for third-party services except to the extent required by applicable law.
Your use of third-party login, payment, or AI infrastructure may be subject to the relevant provider's terms and privacy policies.
Privacy
Our Privacy Policy explains how we collect, use, process, store, and delete information, including uploaded photos and generated reports. By using the service, you agree to the Privacy Policy.
Service Availability
We may update, change, suspend, or discontinue any part of the service at any time. We do not guarantee that the service will be uninterrupted, secure, error-free, or available at all times.
We are not responsible for data loss, report expiration, temporary unavailability, provider outages, or failures outside our reasonable control.
Disclaimer of Warranties
The service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Limitation of Liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost reports, business interruption, or reputational harm arising from or related to your use of the service.
Our total liability for any claim arising from or related to the service will be limited to the amount you paid us for the service giving rise to the claim during the 12 months before the claim arose, or USD $100 if you did not pay us during that period.
Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you.
Indemnification
You agree to defend, indemnify, and hold us harmless from claims, liabilities, damages, losses, and expenses arising from your misuse of the service, your uploaded content, your violation of these Terms, or your violation of another person's rights.
Copyright and Rights Complaints
If you believe content on the service infringes your copyright or other rights, please contact us with enough information for us to identify the content and evaluate your request. We may remove or restrict access to content where appropriate.
Changes to These Terms
We may update these Terms from time to time. We will post the updated version on this page. If a change is material, we may provide additional notice where appropriate. Your continued use of the service after updated Terms are posted means you accept the updated Terms.
Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of law rules, unless applicable consumer protection law requires otherwise.
